The inclusion of the Client\u2019s own conditions is herewith objected to, unless other terms have been stipulated.<\/p>\n<p><strong>1.2<\/strong>\u2009These Terms and Conditions regarding contracts for the supply of goods presented by the Seller in its print catalogue apply accordingly, unless expressly otherwise agreed.<\/p>\n<p><strong>1.3<\/strong>\u2009For contracts regarding the delivery of vouchers, these Terms and Conditions shall apply accordingly, unless expressly agreed otherwise.<\/p>\n<p><strong>1.4<\/strong>\u2009A consumer pursuant to these Terms and Conditions is any natural person concluding a legal transaction for a purpose attributed neither to a mainly commercial nor a self-employed occupational activity. A trader pursuant to these Terms and Conditions is any natural or legal person or partnership with legal capacity acting in the performance of a commercial or self-employed occupational activity when concluding a legal transaction.<\/p>\n<p><strong>1.5<\/strong>\u2009Digital content in the sense of these General Terms and Conditions are all data not on a tangible medium which are produced in digital form and are supplied by the Seller by granting certain usage rights precisely defined in these General Terms and Conditions.<\/p>\n<h2>2) Conclusion of the Contract<\/h2>\n<p><strong>2.1<\/strong>\u2009The product descriptions in the Seller\u2019s online shop do not constitute binding offers on the part of the Seller, but merely serve the purpose of submitting a binding offer by the Client.<\/p>\n<p><strong>2.2<\/strong>\u2009The Client may submit the offer via the online order form integrated into the Seller&#8217;s online shop. In doing so, after having placed the selected goods and\/or services in the virtual basket and passed through the ordering process, and by clicking the button finalizing the order process, the Client submits a legally binding offer of contract with regard to the goods and\/or services contained in the shopping cart. The Client may also submit his offer to the Seller by e-mail.<\/p>\n<p><strong>2.3<\/strong>\u2009In case of ordering goods presented in the Seller\u2019s print catalogue, the Client may submit his offer by telephone, fax, e-mail or postal service. For this purpose, the Client may fill in the order form attached to the Seller\u2019s print catalogue and return it to the Seller.<\/p>\n<p><strong>2.4<\/strong>\u2009The Seller may accept the Client\u2019s offer within five days,<\/p>\n<ul>\n<li>by transferring a written order confirmation or an order confirmation in written form (fax or e-mail); insofar receipt of order confirmation by the Client is decisive, or<\/li>\n<li>by delivering ordered goods to the Client; insofar receipt of goods by the customer is decisive, or<\/li>\n<li>by requesting the Client to pay after he placed his order.<\/li>\n<\/ul>\n<p>Provided that several of the aforementioned alternatives apply, the contract shall be concluded at the time when one of the aforementioned alternatives firstly occurs. Should the Seller not accept the Client\u2019s offer within the aforementioned period of time, this shall be deemed as rejecting the offer with the effect that the Client is no longer bound by his statement of intent.<\/p>\n<p><strong>2.5<\/strong>\u2009If the Client chooses &#8220;PayPal Express\u201d when placing his order, payment processing is handled by the payment service provider PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter referred to as \u201cPayPal\u201d). The PayPal terms of use shall apply which can be viewed at: <a href=\"https:\/\/www.paypal.com\/ie\/webapps\/mpp\/ua\/servicedescription-full?locale.x=en_IE\">https:\/\/www.paypal.com\/ie\/webapps\/mpp\/ua\/servicedescription-full?locale.x=en_IE<\/a>.<\/p>\n<p>In case the Client has no PayPal account, the conditions for payments without PayPal account will apply which can be viewed at: <a href=\"https:\/\/www.paypal.com\/ie\/webapps\/mpp\/ua\/legalhub-full?locale.x=en_US\" target=\"_blank\" rel=\"noopener\">https:\/\/www.paypal.com\/ie\/webapps\/mpp\/ua\/legalhub-full?locale.x=en_US<\/a>.<\/p>\n<p>If the Client chooses \u201cPayPal Express\u201d as payment method, he initiates also a payment order to PayPal by clicking the button finalizing the order process. In this case, the Seller declares his acceptance of the Client\u2019s offer already at the time when the Client initiates the payment transaction by clicking the button finalizing the ordering process.<\/p>\n<p><strong>2.6<\/strong>\u2009If the Client chooses the payment method \u201cAmazon Payments\u201d, payments are processed by the payment service provider Amazon Payments Europe s.c.a., 5 Rue Plaetis, L-2338 Luxemburg (hereinafter referred to as \u201eAmazon\u201c).<\/p>\n<p>If the Client chooses \u201cAmazon Payments\u201d as payment method during the online ordering process, he, at the same time, makes a payment order to Amazon when initiating the payment transaction by clicking the button finalizing the ordering process. In this case, the Seller declares his acceptance of the Client\u2019s offer already at the time, when the Client initiates the payment transaction by clicking the button finalizing the ordering process.<\/p>\n<p><strong>2.7\u2009<\/strong>In case of an order via the Seller\u2019s online order form, the text of the contract will be stored by the Seller and will be sent to the Client in writing including these Terms and Conditions (for example via e-mail, fax or letter) after the Client has submitted his order. In addition, the text of the contract will be stored on the Seller&#8217;s website and can be found by the Client via the password-protected customer account by entering the respective login information, provided that the Client has created a customer account in the Seller\u2019s online shop prior to submitting his order.<\/p>\n<p><strong>2.8<\/strong>\u2009Prior to submitting a binding order via the Seller\u2019s online order form, the Client may recognize input errors by reading attentively the information displayed on the screen. The enlargement function of the browser to enlarge the display on the screen may be an effective method for better recognizing input errors.<br \/>\nThe Client can correct all the data entered via the usual keyboard and mouse function during the electronic ordering process, until he clicks the button finalizing the ordering process.<\/p>\n<p><strong>2.9<\/strong>\u2009The German and the English language are exclusively available for the conclusion of the contract.<\/p>\n<p><strong>2.10<\/strong>\u2009Order processing and contacting usually takes place via e-mail and automated order processing. It is the Client\u2019s responsibility to ensure that the e-mail address he provides for the order processing is accurate so that e-mails sent by the Seller can be received at this address. Particularly, it is the Client`s responsibility, if SPAM filters are used, to ensure that all e-mails sent by the Seller or by third parties commissioned by the Seller with the order processing can be delivered.<\/p>\n<h2>3) Right to Cancel<\/h2>\n<p><strong>3.1<\/strong>\u2009Consumers are entitled to the right to cancel.<\/p>\n<p><strong>3.2<\/strong>\u2009Detailed informations about the right to cancel are provided in the Seller\u2019s instruction on cancellation.<\/p>\n<h2>4) Prices and Payment Conditions<\/h2>\n<p><strong>4.1<\/strong>\u2009Unless otherwise stated in the Seller\u2019s product description, prices indicated are total prices including the statutory sales tax. Delivery costs, where appropriate, will be indicated separately in the respective product description<\/p>\n<p><strong>4.2<\/strong>\u2009Payment can be made using one of the methods mentioned in the Seller\u2019s online shop.<\/p>\n<p><strong>4.3<\/strong>\u2009If prepayment by bank transfer has been agreed upon, payment is due immediately after conclusion of the contract, unless the parties have arranged a later maturity date<\/p>\n<p><strong>4.4<\/strong>\u2009If the payment method \u201cpurchase on account\u201d is selected, the purchase price is due after the goods have been delivered and invoiced. In this case, the purchase price is to be paid within 7 (seven) days from receipt of the invoice without deduction, unless otherwise agreed. The Seller reserves the right to offer the payment method \u201cpurchase on account\u201d only up to a certain order volume, and he may refuse this payment method if the specified order volume is exceeded. In this case, the Seller will inform the Client in his payment information displayed in the online shop of a corresponding payment restriction.<\/p>\n<p><strong>4.5<\/strong>\u2009If the payment method &#8220;PayPal invoice&#8221; is selected, the Seller assigns his payment claim to PayPal. Before accepting the Seller&#8217;s declaration of assignment, PayPal carries out a credit check using the transmitted Client data. The Seller reserves the right to refuse the Client the payment method &#8220;PayPal invoice&#8221; in case of a negative credit check. If the payment method &#8220;PayPal Invoice&#8221; is accepted by PayPal, the Client must pay the invoice amount to PayPal within 30 days from receipt of the goods, unless PayPal specifies a different payment term. In this case, he can only make only payments with debt-relieving effect to PayPal. However, in the event of assignment of claims, the Seller shall remain responsible for general customer inquiries, e. g. regarding the goods, delivery time, dispatch, returns, complaints, revocation declarations and dispatches or credit notes. In addition, the General Terms and Conditions of Use for the use of the payment method \u201cpurchase\u201d on account with PayPal shall apply; these conditions can be viewed at <a href=\"https:\/\/www.paypal.com\/de\/webapps\/mpp\/ua\/pui-terms\" target=\"_blank\" rel=\"noopener\">https:\/\/www.paypal.com\/de\/webapps\/mpp\/ua\/pui-terms<\/a>.<\/p>\n<h2>5) Shipment and Delivery Conditions<\/h2>\n<p><strong>5.1<\/strong>\u2009Goods are generally delivered on dispatch route and to the delivery address indicated by the Client, unless agreed otherwise. During the processing of the transaction, the delivery address indicated in the Seller\u2019s order processing is decisive.<\/p>\n<p><strong>5.2<\/strong>\u2009Should the assigned transport company return the goods to the Seller, because delivery to the Client was not possible, the Client bears the costs for the unsuccessful dispatch. This shall not apply, if the Client exercises his right to cancel effectively, if the delivery cannot be made due to circumstances beyond the Client&#8217;s control or if he has been temporarily impeded to receive the offered service, unless the Seller has notified the Client about the service for a reasonable time in advance.<\/p>\n<p><strong>5.3<\/strong>\u2009Personal collection is not possible for logistical reasons.<\/p>\n<h2>6) Reservation of Proprietary Rights<\/h2>\n<p>If the Seller provides advance deliveries, he retains title of ownership to the delivered goods, until the purchase price owed has been paid in full.<\/p>\n<h2>7) Warranty<\/h2>\n<p><strong>7.1<\/strong>\u2009Should the object of purchase be deficient, statutory provisions shall apply.<\/p>\n<p><strong>7.2<\/strong>\u2009Deviating hereof, for consumers the limitation period regarding warranty claims for used goods shall be one year from delivery of goods to the Client. The shortening of the limitation period does not apply,<\/p>\n<ul>\n<li>for a product, which was not used, in accordance with its usual application, for building construction and which was the cause of the building&#8217;s defectiveness,<\/li>\n<li>for damages arising out of injuries to life, body or health, which result from intentional or negligent violation of the Seller\u2019s duties or the intentional or negligent violation of duties by the legal representative or the vicarious agent of the user,<\/li>\n<li>for other damages resulting from intentional or grossly negligent violation of the Seller\u2019s duties or the intentional or grossly negligent violation of duties by the legal representative or the vicarious agent of the user,<\/li>\n<li>if the Seller has fraudulently concealed the defect.<\/li>\n<\/ul>\n<p><strong>7.3<\/strong>\u2009The Client is asked to notify any obvious transport damages to the forwarding agent and to inform the Seller accordingly. Should the Client fail to comply therewith, this shall not affect his statutory or contractual claims for defects.<\/p>\n<h2>8) Exemption in case of violation of third-party rights<\/h2>\n<p>If ,apart from delivering the goods, the contract obliges the Seller to process those goods according to specifications defined by the Client, the Client has to ensure that contents made available to the Seller for purposes of processing do not violate third-party rights (for example copyrights and trademark rights. The Client shall indemnify the Seller from claims of third parties asserted against the Seller in connection with the violation of their rights by the Seller\u2019s contractual use of the Client\u2019s contents. The Client will meet any reasonable costs of necessary legal defense including all court and lawyer\u2019s fees according to the statutory rate. This shall not apply, if the Client is not responsible for the violation of rights. In case claims are asserted against the Seller, the Client shall be obliged to furnish the Seller promptly, truthfully and completely with all information that is necessary for the verification of the claims asserted and for a corresponding legal defense.<\/p>\n<h2>9) Redemption of campaign vouchers<\/h2>\n<p><strong>9.1<\/strong>\u2009Vouchers which are issued by the Seller free of charge, for a specific period of validity in the context of promotional activities and which cannot be purchased by the Client (hereinafter referred to as &#8220;campaign vouchers\u201d) can only be redeemed in the Seller\u2019s online shop and only within the indicated time period.<\/p>\n<p><strong>9.2<\/strong>\u2009Individual products may be excluded from the voucher campaign, if such a restriction results from the conditions of the campaign voucher.<\/p>\n<p><strong>9.3<\/strong>\u2009Campaign vouchers can only be redeemed prior to the conclusion of the order procedure. Subsequent offsetting is not possible.<\/p>\n<p><strong>9.4<\/strong>\u2009Only one campaign voucher can be redeemed per order.<\/p>\n<p><strong>9.5<\/strong>\u2009The goods value should meet at least the amount of the campaign voucher. The Seller will not refund remaining assets.<\/p>\n<p><strong>9.6<\/strong>\u2009If the value of the campaign voucher is not enough for the order, the Client may choose one of the remaining payment methods offered by the Seller to pay the difference.<\/p>\n<p><strong>9.7<\/strong>\u2009The campaign voucher credit will not be redeemed in cash and is not subject to any interest.<\/p>\n<p><strong>9.8<\/strong>\u2009The campaign voucher will not be redeemed, if the Client, in the context of his legal right to cancel, returns goods paid fully or partially by a campaign voucher.<\/p>\n<p><strong>9.9<\/strong>\u2009Campaign vouchers are only intended for the use of the person designated on the voucher. Transferring the campaign voucher to a third party is not permitted. The Seller is entitled but not obliged to check the entitlement of the respective voucher owner.<\/p>\n<h2>10) Applicable Law<\/h2>\n<p>The law of the Federal Republic of Germany shall apply to all legal relationships between the parties under exclusion of the laws governing the international purchase of movable goods. For consumers, this choice of law only applies to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the country, in which the consumer has his habitual residence.<\/p>\n<h2>11) Place of Jurisdiction<\/h2>\n<p>If the Client is a businessman, a legal entity of public law or a separate estate under public law with its seat in the territory of the Federal Republic of Germany, the Seller\u2019s place of business shall be the sole place of jurisdiction for all legal disputes arising from this contract.. If the Client is domiciled outside the territory of the Federal Republic of Germany, the Seller\u2019s place of business shall be the sole place of jurisdiction for all legal disputes arising from this contract provided that the contract or claims from the contract can be assigned to the Client\u2019s professional or commercial activities. In any event however, regarding the aforementioned cases the Seller is entitled to call the court responsible for the seat of the Client.<\/p>\n<h2>12) Alternative dispute resolution<\/h2>\n<p><strong>12.1<\/strong>\u2009The EU Commission provides on its website the following link to the ODR platform: <a href=\"https:\/\/ec.europa.eu\/consumers\/odr\" target=\"_blank\" rel=\"noopener\">https:\/\/ec.europa.eu\/consumers\/odr<\/a>.<\/p>\n<p>This platform shall be a point of entry for out-of-court resolutions of disputes arising from online sales and service contracts concluded between consumers and traders.<\/p>\n<p><strong>12.2<\/strong>\u2009The Seller is not obliged to use ADR entities to resolve disputes with consumers, but he is in priniciple ready for this.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>General Terms and Conditions Table of Contents Scope of Application Conclusion of the Contract Right to Cancel Prices and Payment<\/p>\n","protected":false},"author":1,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"_uf_show_specific_survey":0,"_uf_disable_surveys":false,"jetpack_post_was_ever_published":false,"footnotes":""},"class_list":["post-2645","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.3 (Yoast SEO v27.3) - https:\/\/yoast.com\/product\/yoast-seo-premium-wordpress\/ -->\n<title>Terms &amp;
